2. Ordering Artworks

2.1. Order Process

  • Orders are placed through contact forms or email
  • After confirming details, you will receive a secure Stripe checkout link
  • Prices include agreed shipping costs; insurance is optional
  • You must provide accurate delivery information

2.2. Order Confirmation

  • You will receive an email confirmation once your order is placed
  • Payment must be completed within the specified timeframe
  • Orders are not final until payment is confirmed

3. Payments

3.1. Payment Processing

  • All payments are processed securely through Stripe
  • We do not store or have access to your card or banking data
  • Accepted payment methods: Credit cards, debit cards (as supported by Stripe)

3.2. Pricing and Currency

  • All prices are displayed in USD unless otherwise stated
  • The seller is not VAT-registered in Poland. Prices do not include VAT; VAT is not charged or collected on sales; VAT invoices are not issued
  • You are responsible for any customs duties, import VAT, or taxes in your country (for deliveries outside the EU)

3.3. Billing Information

  • Billing details are collected only for invoicing and legal compliance
  • Invoices will be sent to the email address you provide

4. Intellectual Property

4.1. Copyright

  • When you purchase an artwork, you acquire only the physical object
  • Copyright and reproduction rights remain with the artist (Iwona Siwek-Front)
  • Greta Front acts solely as seller/operator of this shop and does not acquire the artist's copyright
  • You may not reproduce, distribute, or publicly display the artwork without written consent

4.2. Website Content

  • All website content, including images, text, and design, is protected by copyright
  • You may not copy, reproduce, or redistribute website content without permission

5. User Responsibilities

By using this website, you agree not to:

  • Upload viruses or malicious code
  • Attempt to breach security measures
  • Misuse the website or interfere with its operation
  • Copy or redistribute content without authorization
  • Use the website for unlawful purposes
  • Impersonate another person or entity

6. Right of Withdrawal

6.1. Artwork Purchases

Due to the unique nature of original artworks, all sales are final unless the artwork arrives damaged. This is in accordance with Article 38 of the Polish Consumer Rights Act and is standard in international art sales.

6.2. Returns and Refunds

Returns are only possible when:

  • The artwork arrives damaged during shipping (report within 48 hours with photos)
  • The artwork received does not match the description (our error)
  • There was an error in our order fulfillment

7. Shipping and Delivery

7.1. Shipping Methods

  • Standard shipping: 5-10 business days
  • Express shipping: 2-3 business days (where available)
  • Shipping costs are calculated at checkout

7.2. Delivery Responsibility

  • You are responsible for providing accurate shipping information
  • We are not responsible for delays caused by:
  • Incorrect addresses
  • Courier delays
  • Customs clearance delays
  • Force majeure events

7.3. Risk of Loss

  • Risk of loss transfers to you upon delivery to the carrier
  • All shipments are fully tracked and insured for the full value of the artwork

8. Liability

8.1. Limitation of Liability

To the maximum extent permitted by Polish law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the purchase price of the artwork
  • We are not responsible for losses resulting from website use, except where required by law

8.2. Exceptions

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under applicable law

9. Warranty and Representations

9.1. Artwork Authenticity

  • All artworks are original creations by Iwona Siwek-Front
  • Greta Front sells the artworks as the merchant of record on behalf of the artist
  • We guarantee the authenticity of all works sold
  • Certificates of authenticity are available upon request

9.2. Condition

  • Artworks are sold in the condition described
  • We make reasonable efforts to accurately describe and photograph each piece
  • Slight variations in color may occur due to screen settings

10. Cancellation by Us

We reserve the right to cancel orders in the following circumstances:

  • The artwork is no longer available
  • Payment cannot be verified
  • We suspect fraudulent activity
  • Force majeure events

If we cancel your order, you will receive a full refund.

11. Third-Party Websites

  • Our website may contain links to third-party websites
  • Links are provided for convenience only
  • We are not responsible for the content, security, or privacy practices of third-party websites
  • Visiting third-party websites is at your own risk

12. Dispute Resolution

12.1. Governing Law

These Terms are governed by the laws of Poland, without regard to its conflict of law provisions.

12.2. Jurisdiction

Any disputes, claims, or controversies arising from these Terms, your use of the website, or any transactions conducted through the website will be subject to the exclusive jurisdiction of the competent courts in Kraków, Poland.

You agree to submit to the personal jurisdiction of these courts and waive any objections to venue or forum.

12.3. Informal Resolution Process

We strongly encourage resolving disputes through direct communication before pursuing legal action:

  • If we cannot resolve the matter informally within 30 days, you may proceed with formal legal action
